Personal Profile
1. Business Areas
Civil and commercial litigation and arbitration in finance, real estate, and construction engineering, with a particular focus on preservation and enforcement, as well as non-litigation services such as bankruptcy, debt restructuring, and non-performing asset disposal.
2. Classic Cases
(1) Represented multiple state-owned and central enterprise construction companies in construction contract disputes, including a series of disputes involving Evergrande, Greenland and others, providing litigation, arbitration, preservation and enforcement legal services, participating in the entire process from case contact and service plan drafting to court hearings and enforcement applications, and some cases have now obtained favorable judgments and have been enforced. (2) Provided bankruptcy creditor realization legal services to many state-owned enterprises and private enterprises. In the bankruptcy proceedings of clients' debtors (including Zhongwang Group, Yangzhou Asia-Pacific Real Estate, Kangdexin Group, etc.), we promoted the bankruptcy process by verifying and objecting to claims, verifying and objecting to assessments, and actively participating in the negotiation and voting of various proposals such as the reorganization plan (draft), so as to maximize the realization of clients' claims. Among them, we have helped some companies to successfully reorganize, and some bankruptcy cases have received phased repayments. (3) Provided non-litigation legal services to many asset management companies in debt acquisition and asset due diligence projects, including communicating with the business leaders of client units, understanding the transaction structure, reviewing project contracts and other documents, and issuing legal opinions. (4) Provided litigation and non-litigation legal services to multiple banks, including CITIC Bank Hefei Branch, Huishang Bank Hefei Branch, and China Everbright Bank Hefei Branch, including litigation and enforcement case representation, and completed debt collection for clients. (5) As a member of the bankruptcy administrator team, participated in the bankruptcy projects of several real estate development companies, from the preparation of creditor declaration materials to on-site creditor declaration, review and other asset verification stages, to the convening of creditor meetings, the design of reorganization plans, and negotiations with reorganization investors. Ultimately, some projects were successfully reorganized. (6) Representing listed companies and other real estate development companies in construction contract disputes with construction companies. For example, a group company and its affiliated companies had a dispute with China Construction Seventh Engineering Bureau Second Construction Co., Ltd. over the construction of three construction projects in Fuyang. The projects involved government resettlement housing and other policy-oriented construction projects. Due to the dispute, the work was suspended for a time. After the legal team intervened, they collected, sorted and analyzed the construction contracts and other materials, designed a solution and path for handling the project disputes, and issued relevant legal opinions; participated in and assisted the client in negotiations and consultations with the other party in the dispute; drafted correspondence, lawsuits, and preservation measures. They resolved the disputes for the client from both litigation and non-litigation perspectives, so that the project disputes were resolved quickly and construction resumed. (7) Participation in the merger and acquisition project between a certain group and a large foreign-invested group and its more than ten subsidiaries. This merger and acquisition project involved our legal team being commissioned by the acquiring party to provide full-process legal services, including due diligence, acquisition plan design, negotiation, and closing, for the large foreign-invested group and its more than ten subsidiaries, including those in the hotel, real estate, property, and golf course sectors. Ultimately, the project was successfully completed and the closing was achieved, exceeding the client's expectations. In handling such large-scale merger and acquisition projects, the preliminary due diligence checklist, template documents, and other materials are essential. (8) As a member of the legal team, I provided special legal services to a county-level people's government regarding the restructuring of a real estate project. I was responsible for due diligence work, including reviewing the company's basic information, conducting on-site investigations, interviewing senior executives, and drafting due diligence reports. The project started development and construction in February 2013. Due to problems with the entrusted management, the project was suspended multiple times, eventually becoming an unfinished building, involving thousands of small property owners, and putting great pressure on the government to maintain stability. After the legal team intervened, they completed the basic due diligence within two weeks, submitted a legal plan for resuming construction and handing over the property within one month, and assisted the county government in negotiating with relevant companies. Ultimately, the project was able to resume construction and hand over the property smoothly.
